بیانیه کانون صنفی معلمان ایران(تهران) در اعتراض به حکم صادر شده برای محمدتقی‌فلاحی دبیر کانون صنفی معلمان ایران(تهران)
از سوی شعبه ۲۶ دادگاه انقلاب

🔹اصل ۲۶ قانون اساسی:
احزاب، جمعیت‌ها، انجمن‌های سیاسی و صنفی و انجمن‌های اسلامی یا اقلیتهای دینی شناخته شده آزادند، مشروط به این که اصول استقلال، آزادی، وحدت ملی، موازین اسلامی و اساس جمهوری اسلامی را نقض نکنند. هیچ‌کس را #نمی‌توان از شرکت در آنها منع کرد یا به شرکت در یکی از آنها مجبور ساخت.

🔹بار دیگر شاهد صدور حکم ناباورانه دیگری، برای اعضای کانون صنفی معلمان ایران هستیم.
این اولین بار نیست که اعضای کانون صنفی معلمان در سراسر کشور مورد بازجویی و احکام سنگین قضایی قرار میگیرند و متاسفانه گویی پایان هم ندارد!

🔹محمدتقی فلاحی دبیر متین کانون صنفی معلمان تهران با یورش ماموران به خانه‌اش در ۱۹ بهمن سال گذشته بازداشت می‌شود، وسایل ارتباطی او ضبط و پس از حدود یک هفته با قید وثیقه بطور موقت آزاد می‌شود.
و در ماه جاری (مرداد ماه)، طی حکمی از سوی شعبه ۲۶ دادگاه انقلاب تهران، در حالی به دو سال حبس محکوم می شود که به گواه بسیاری از فعالان مدنی و صنفی معلمان، ایشان همواره در جهت راهبردهایی کاربردی و بدور از هیجانات، و بر اساس قوانین مدون در جهت نیل به اهداف عالی و ارزنده آموزشی کشور تلاش ‌کرده و هرگز از مسیر عقلانیت خارج نشده است.

🔹دبیر کانون صنفی معلمان تهران در طول دوران فعالیت صنفی خود بر مسیر کار جمعی گام برداشته و شاکله و هدف همه‌ فعالیت او با آرا، نظرات و تصمیمات دیگر اعضای هیات مدیره کانون صنفی معلمان تهران همراستا بوده است. بدون شک اعضای هیات مدیره کانون صنفی معلمان تهران اتهام وارده به ایشان را با استناد به قانون اساسی – از جمله اصل ۲۶ – بی اساس می‌دانند.

🔹محمد تقی فلاحی دبیر آرام کانون صنفی با اتهام اجتماع و تبانی از طریق شرکت در تشکل قانونی کانون صنفی معلمان به دوسال حبس محکوم می‌شود. درحالی که اصل۲۶ قانون اساسی کشور به صراحت این حق را برای همه محفوظ می دارد. دستگاه و ضابطین قضایی قبل از آنکه جرمی را به گروه یا فردی منتسب کنند، باید به قوانین پایه ای کشور رجوع و بر اساس و محوریت آن تصمیم گیری کنند. مگر آنکه عده ای با طرح اتهامات خلاف قانون، خود را فراتر از قانون و مرجع تام الاختیار بدانند.
واضح است با اتهامی که به ایشان نسبت داده شده است همه‌ اعضای کانونهای صنفی و همه تشکلهای مستقل صنفی و مدنی و همه احزاب و سازمانها چون جناب فلاحی محکوم هستند و بر اساس این دیدگاهِ مسئولان قضایی و حاکمیت، همه‌ حرکت‌هایی که کاستی‌ها و قصور سیستم موجود را آشکار کنند، مجرمند و لایق اعدام و زندان و شلاق … !!!

🔹محمدتقی فلاحی در حالی به دوسال حبس محکوم می شود که فعالان صنفی در سراسر کشور بارها شاهد صدور احکام این‌چنینی بوده‌اند و این‌روزها شدت صدور احکام اعدام ،زندان ،شلاق ‌و… بیشتر از گذشته برای فعالان مدنی و صنفی جایز شمرده می‌شود. احکامی که بازخورد عکس در جامعه داشته و بجای ایجاد فضای خفقان، بسیاری از همکاران و فعالان صنفی عرصه آموزش را برمسیر حق و حقیقت استوارتر کرده است.

🔹کانون صنفی معلمان تهران اعلام می‌کند که با وجود فشارهایی که بر جامعه مدنی و نهادهای صنفی وارد می‌شود، این نهادها همچنان در جهت ارزش‌گذاری به قانون و اعتلای جامعه معلمان و آموزش کشور تلاش خواهد کرد و از برخوردهای اعمال شده هراس و بیمی نداشته و ندارد.

🔹کانون صنفی معلمان تهران با تمام توان خود از فعالیت‌های دبیر خود جناب محمدتقی‌فلاحی دفاع کرده و اعلام می‌نماید ایشان هیچ فعالیتی بر خلاف تصمیمات و نظرات کانون صنفی معلمان تهران نداشته و همواره بر مسیر قانون گام برداشته است.

🔹کانون صنفی معلمان ایران(تهران) بار دیگر صدور این قبیل احکام ظالمانه برای فعالان صنفی و مدنی را بشدت محکوم می‌کند و به مردم ایران و معلمان این سرزمین اعلام می دارد همچنان برای رسیدن به حقوق صنفی و بر حق دانش‌آموزان، فرهنگیان شاغل و بازنشسته‌ ادامه خواهد داد و از قوه قضایی کشور می‌خواهد به قوانین کشور احترام بگذارد و با بصیرت بیشتر اتهامات را بررسی، سپس حکم صادر کند.
