بیانیه شورای هماهنگی تشکل های صنفی فرهنگیان ایران

به نام خداوند جان و خرد

براساس نص صریح اصل ۱۵۶ قانون اساسی، قوه قضاییه قوه ای است مستقل که پشتیبان حقوق فردی و اجتماعی، مسئول تحقق بخشیدن به عدالت، عهده دار رسیدگی و صدور حکم درخصوص تعدیات و تظلمات، احیای حقوق عمومی و گسترش عدل و آزادی های مشروع، نظارت بر حسن اجرای قانون، کشف جرم و تعقیب، تعزیر و مجازات مجرم و اقدام لازم در جهت پیشگیری از وقوع جرم و اصلاح مجرم  است.

شورای هماهنگی تشکل های صنفی فرهنگیان ایران با توجه به برخوردهای فراقانونی ارکان قضایی کشور با کنشگران صنفی فرهنگی، به نمایندگی از همکاران خود، پس از طرح موضوع، چند پرسش از مسئولان قوه قضاییه دارد که انتظار می رود در راستای وظایف مصرح این قوه در قانون اساسی و به احترام افکار عمومی، پاسخی درخور به آنها ارائه نماید.

مجلس شورای اسلامی در تاریخ چهارم بهمن ۱۳۹۴ با نقض عامدانه بخشی از اصل ۲۶ قانون اساسی و با تغییر انحصارخواهانه قانون موجود در زمینه فعالیت نهادهای مدنی و تایید آن در هشتم آبان ۱۳۹۵ توسط مجمع تشخیص مصلحت، آگاهانه به حذف پایگاه رسمی و قانونی فعالیت تشکل های صنفی در سازه قانون جدید یعنی قانون نحوه فعالیت احزاب و گروه های سیاسی اقدام نمود و رسما حق مسلم کنشگری صنفی را از دفتر قوانین جاری کشور سترد تا از همان تاریخ، دست نهادهای امنیتی و قضایی برای تعلیق، تبعید و تحدید هرگونه فعالیت صنفی باز باشد و حفظ منافع جناح های قدرت در پوشش تامین امنیت ملی، به فرآیندی متداول و روتین بدل گردد. به نحوی که با غلبه این شرایط، کنشگری صنفی معلمان در مرامنامه دستگاه قضایی به عنوان فعالیتی ساختارشکن علیه امنیت ملی و موجبی مخرب برای تشویش اذهان عمومی و تبلیغ علیه مبانی نظام، تعریف و تحلیل شد و مبنای صدور احکام ناعادلانه بسیاری علیه فعالان صنفی فرهنگی قرار گرفت.

در تداوم این سریال قانون گریزانه که نفی و امحای حق فعالیت آزاد صنفی را نشانه گرفته بود، اصلاح قانون نحوه فعالیت احزاب و گروه های سیاسی در جهت اعاده حقوق تشکل های صنفی نیز در سال های بعد، بویژه درسال پایانی عمر مجلس دهم به نمایشی از چوگان سیاسی کاری تبدیل گردید که در اثنای آن، حق کنشگری صنفی، سیلی خور ضربه های سیاسانه مجلس و شورای نگهیان گردید تا همچنان تعلیق، بلاتکلیفی و استیصال تنها راهی باشد که ارکان قدرت به روی کنشگران صنفی  باز گذاشته باشند.

صدور احکام سنگین قضایی با عناوین امنیتی و بی پایه و اساس علیه معلمان خراسان شمالی، تداوم حبس دو تن از اعضای هیئت مدیره کانون صنفی معلمان تهران در زندانی با کمترین امکانات بهداشتی،آن هم بدون تخصیص حق قانونی مرخصی از مصادیق مدعایی است که ذکر گردید.

در ادامه این فضای عدالت گریز و قانون ستیز، اخیرا محمد فلاحی، دبیرکل کانون صنفی معلمان تهران که بدون تردید از حیث آراستگی به صفات نیکی چون فرهیختگی، نجابت، شکیبایی و پایبندی عملی به رفتار فرهنگ مدار و قانون مند، از جمله شاخص ترین کنشگران صنفی فرهنگی به شمار می آید، با همان اتهامات متعارف و ابزارگونه ای که در خصوص فعالان صنفی، نام و عنوانی امنیتی اما محتوایی صنفی دارد با حکم دو سال حبس تعزیری قطعی از سوی دادگاه انقلاب تهران مواجه شده است تا این دادنامه نیز نامه ای دیگر برای ثبت مصداق بارز بی عدالتی در دفتر تاریخ و نیز ابزاری با پوشش تامین امنیت  برای دهشتناک جلوه دادن فعالیت صنفی و تبعید این حق مسلم مدنی در نزد جامعه فرهنگی باشد.

پرسش از راس هرم قضایی کشور و مسئول اصلی تحقق بخشیدن به اصل ۱۵۶ قانون اساسی، این است که :

۱-آیا سکوت، بی عملی و چشم فروبستن قوه قضاییه بر این قانون شکنی ها و عدالت سوزی های آشکار، نادیده انگاشتن رسالت این قوه و زیرمجموعه های آن در پشتیبانی از حقوق فردی و اجتماعی و اهمال این نهاد در احیای حقوق عامه و گسترش عدل و آزادی های مشروع نیست؟ آیا روند رسیدگی وکیفیت احکام برخی از قضات دادگستری در حوزه اتهامات فعالان صنفی فرهنگی با رسالت «کشف جرم و تعقیب، تعزیر و مجازات مجرمان» که از بدیهیات وظایف قوه قضاییه است، تباین و منافات نداشته و موجب تغییر جای بزهکار و بزه دیده نشده است؟ آیا قوه قضاییه هرگز برای شناسایی و کشف موجبات و ژرف ساخت های بروز شرایط موجود به خود، زحمت تحقیق و تفحص داده است.

۲ – وقتی در تمام پرونده های این چنینی، همواره سهمیه کنشگران صنفی، محکومیت قابل پیش بینی به مجازات های امنیتی، و پیشانی نوشت صاحب منصبان ذیربط، رانت دائمی برائت است و هرگز اتهامی ساده و حداقلی نیز در حریم حرمت رانتی هیچ مقام مسئولی، راه ندارد، آیا احکام قضایی صادره را می توان مشحون از مولفه های استقلال و عدالت قضایی و مبرا از دخالت های مبادی قدرت، تصور نمود؟

۳-در اصل ۱۵۶ قانون اساسی، «نظارت بر حسن اجرای قانون» ازجمله مسئولیت های قوه قضاییه به شمار آمده است.آیا این قوه در زمینه قانون شکنی مجلس، شورای نگهبان و مجمع تشخیص مصلحت که با تحریف و تخفیف اصل ۲۶ قانون اساسی، سالهاست که حق فعالیت صنفی را خرق نموده و زمینه بسیاری از مشکلات موجود را فراهم کرده اند، کمترین اقدامی انجام داده است یا کماکان در مانیفست دستگاه قضایی، صاحب منصبان، معصوم و عاری از هرگونه اشتباه تعریف می شوند و ارتکاب جرم، صرفا در انحصار سرنوشت محتوم ملتی است که در توهم شعار، سالار هستند و در باتلاق واقعیت، محکوم علیه همیشگی؟

۴- آیا اتفاق افتاده است که یکبار قوه قضاییه در خصوص جلسات محاکمه فعالان صنفی فرهنگی به اصل ۱۶۵ قانون اساسی، تمکین نموده و محاکمات آنها را علنی و با حضور رسانه های آزاد، برگزار نماید تا معلوم شود کنشگران صنفی، مخل امنیت ملی هستند یا مسئولانی که مصالح شخصی، سیاسی و جناحی را در لفافه عبارات عوام فریبانه و شعارهای بی محتوا بر سرنوشت مردم تحمیل می کنند؟

۵- آیا هرگز اتفاق افتاده است که دادستان کل کشور یا دادستان مجری حکم، به اعتراضات مکرر فرهنگیان نسبت به کیفیت احکام قضایی صادره علیه فعالان صنفی، احترام گذاشته و از اختیار خود در ماده ۴۷۵ قانون آیین دادرسی کیفری برای فرجام خواهی و بررسی دقیق تر پرونده ها استفاده و بخش بزرگی از جمعیت کشور را نسبت به استقلال این قوه، امیدوار نماید؟

شورای هماهنگی تشکل های صنفی فرهنگیان ایران ضمن احترام به چارچوب های قانونی (و نه تصمیمات فراقانونی) و اعلام برائت مطلق از هرگونه جریان مخرب سیاسی داخلی و خارجی، از قوه قضاییه موکدا درخواست می کند پرونده های فعالان صنفی فرهنگی در سراسر کشور را فارغ از دخالت های بلاوجه و فراقانونی نهادهای قدرت، در بستر واقعی قوانین موجود و در فضایی آزاد و عاری از مصلحت هایی که قربانگاه حقیقت هستند، مورد بازنگری و بازبینی عادلانه قرار دهد تا ژرفای واقعیت های تلخ جامعه بر همگان آشکار گردد. به عنوان اولین اقدام عملی، پیشنهاد می شود جلسه رسیدگی به اتهامات امنیتی محمد فلاحی، دبیرکل کانون صنفی معلمان تهران در قالب اجرای مواد ۴۶۴ الی ۴۸۳ قانون آیین دادرسی، برگزار و از طریق رسانه ملی در معرض دید عامه مردم قرار داده شود تا مردمی که در شعار، صاحبان مملکت برشمرده می شوند، دوست و دشمن واقعی را بی واسطه و بدون عینکی که بالاجبار بر چشم آنها تحمیل شده است، بشناسند و معلومشان شود که حساب چه کسانی پاک و از آن چه کسانی، ریشه در خلاب فساد دارد.

شورای هماهنگی به احترام قوانین و شرایط خاص جامعه، منتظر می ماند تا با تدبیر مسئولان قضایی، زمینه ای مساعد و مدبرانه برای اجرای عدالت درخصوص متهمان و زندانیان صنفی فرهنگی در سراسر کشور فراهم گردد؛ در غیر این صورت، بر این شورا مسلم می گردد که اراده ای آشکار، با نام حفظ امنیت و مصلحت کشور و نظام اما به کام منافع اشخاص و جناح های قدرت، برآن است تا با خرق قانون، فرهنگیان را برای دفاع از حقوق خود و همکارانشان، ناگزیر به تجمعات اعتراض آمیزی نماید که قلبا به آن رضا ندارند. امید آنکه عقلانیت و مصالح واقعی کشور، مبنای هرگونه تصمیم یا واکنش منطقی و عادلانه در این زمینه قرار گیرد.
